1. General Provisions
1.1. This agreement governs the terms and conditions for the products and services of SenelExpress GmbH and the customer.
1.2. The customer agrees to the terms set forth in this agreement.
1.3. SenelExpress reserves the right to modify services, payment terms, and other operational details. All changes will be communicated to the customer in writing.
2. Provision and Use of Services
2.1. SenelExpress provides its services in accordance with legal requirements and the terms of this agreement.
2.2. The customer may use the services only for lawful purposes.
2.3. SenelExpress will take all necessary technical and operational measures to ensure uninterrupted service delivery. However, interruptions may occur due to force majeure or external influences.
3. Contract Duration and Termination
3.1. This agreement comes into effect upon signature by both parties.
3.2. Either party may terminate the agreement by written notice. Termination is effective from the date of notification.
3.3. In case of termination, the customer must immediately settle any outstanding amounts.
3.4. SenelExpress reserves the right to review whether a refund of amounts paid by the customer is applicable after termination.
4. Confidentiality and Data Protection
4.1. SenelExpress undertakes to treat all customer data confidentially and not to share it with third parties unless required by law or contract.
4.2. The customer’s personal data will only be used within the scope of this agreement and processed according to data protection laws.
4.3. SenelExpress will implement all necessary security measures to ensure the confidentiality of customer data.
5. Duties and Liability
5.1. SenelExpress will take all necessary measures to provide the services properly and on time.
5.2. The customer is obliged not to use the services unlawfully.
5.3. SenelExpress is not liable for any damages arising from the use of the services.
5.4. The customer must immediately inform SenelExpress of any damages or issues and assist in resolving them.
6. Payment Terms
6.1. The customer agrees to pay the fees for the services according to the payment plan.
6.2. Payments must be made by the due date. In case of late payment, SenelExpress may charge default interest.
6.3. The customer is obliged to pay all fees for the use of the services.
7. Governing Law and Jurisdiction
7.1. This agreement is governed by the laws of Germany.
7.2. All disputes arising from this agreement shall be subject to the courts of Berlin.
